2020年4月13日、FIAジャパンは、金融庁、経済産業省、農林水産省に対し、「エネルギー先物市場を含む全てのTOCOM商品デリバティブ市場を総合取引所となる大阪取引所(OSE)に移管を行う事が適切である」旨の提言を行いました。 昨年11月に日本取引所(JPX)グループの単独子会社として東京商品取引所(TOCOM)を買収し、本年7月にはTOCOMの貴金属、農産品及びゴム市場をOSEに移管する予定であるものの、原油や電力先物を含むエネルギー製品市場はTOCOMに引き続き存続されます。これは事実上、わが国の商品デリバティブ市場が二分割され、金融商品取引法と商品先物取引法の二組の異なる法規制に基づき、異なる規制当局(金融庁、経済産業省)の監督の下に市場及び市場参加者等、関係企業の運営が余儀なくされることとなります。FIAジャパンは本邦における総合取引所発展を踏まえ、内外の会員およびその他の金融・商品市場参加者が抱く下記の懸念を共有した上で提言を行いました。
OSEとTOCOMの両商品デリバティブ市場取引を行う、市場ユーザーとブローカーは異なる二組の法令に対応する報告要件等を遵守する必要があり、市場参加者にとって大きな負担と障害になる。
上記市場構造が継続されれば、既存のエネルギー市場参加者の離脱および国内外の金融市場や他市場からの新たな市場参加者の減少につながり、商品デリバティブ市場の発展を阻害する原因となる。
JPX傘下において、エネルギー商品に限定されたTOCOMの取引所としての運営は、商品範囲、取引利便性が限定され、市場参加者の費用対効果が見込まれないので、市場参加者は限定され、市場流動性と安定した収益の確保が困難となり、ひいては競争力ある取引環境の提供・維持の障害となる
FIAJの規制当局に対する、上記懸念事項に対応する提言
FIAJは、これらの懸念事項と提言を規制機関に表明し、同時に規制当局、取引所、市場参加者等との間における一連の円卓意見交換会を早期に実現できるよう提案しました。円卓意見交換会では、簡素化された単一の規制環境下で総合取引所を確立し、かつ市場成長を促し、アジアのベンチマーク商品市場とグローバル金融センターとしての地位を取り戻すための最善策を議論する予定です。

On April 13, 2020, FIA Japan issued a strong letter to the Financial Services Agency, the Ministry of Economy, Trade and Industry, and the Ministry of Agriculture, Forestry and Fisheries requesting that energy futures products trading be transferred to the comprehensive exchange now being organized at the Osaka Exchange (OSE).
Following the acquisition of Tokyo Commodity Exchange (TOCOM) as a stand-alone subsidiary of Japan Exchange (JPX) Group in November last year, the current plan is for JPX to transfer all TOCOM precious metals, agricultural and rubber derivatives to OSE in July 2020; however, TOCOM will retain all energy products, including crude oil and electricity futures. This would in effect split the commodity market into two, with two sets of laws and regulations under two regulators (i.e. FSA to regulate OSE-listed products under the Financial Instruments and Exchange Act; METI to regulate TOCOM energy products under the Commodity Derivatives Act). FIA Japan has the following related concerns held by its members and other financial and commodity market participants:
To trade both OSE and TOCOM commodities, two sets of laws, regulations and ordinances will apply, with separate reporting requirements for market users and brokers. This is a significant burden and impediment for market participants.
If this structure of the market continues, it will hamper the development of the overall derivatives market. It could also lead to the exit (and limited new entry) of participants that would harm the energy market.
TOCOM, as an energy-only market, will be stressed to try to offer an attractive cost/benefit proposal to potential market players. Potential users may choose not to participate in the market, in which case the market will shrink, and maintaining and developing liquidity will be difficult.
FIAJ made the following suggestions and comments to the regulators:
The FIAJ Letter expressed these concerns and suggestions to the regulatory bodies. FIAJ also intends to hold, as soon as possible, a series of roundtable meetings with all relevant parties including the regulators, exchanges and market users. The meetings will discuss how Japan could best move forward to establish a comprehensive exchange under a single regulatory environment, in order to achieve growth and reclaim its position as a benchmark commodity marketplace and a global financial center.
